Hearing Friday for Regal Cinema Weapons Suspect

Scott A. Smith remains in Cuyahoga County Jail following arrest for bringing gun, ammunition, knives to showing of 'The Dark Knight Rises' at Crocker Park movie theater

Scott A. Smith will have his first hearing Friday afternoon after his arrest on weapons charges for allegedly bringing a loaded gun, ammunition and four knives into a showing of The Dark Knight Rises at Regal Cinema in Crocker Park. A hearing was set for 1:45 p.m. Friday at the Cuyahoga County Court of Common Pleas in Cleveland. No charges were listed on the docket as of Wednesday night. Smith will have to be formally charged before any bond could be set, said Nicole DiSanto of the Cuyahoga County Prosecutor's Office. Initial charges from Saturday's arrest were carrying various weapons, carrying a concealed weapon and having weapons under disability. Updated 5:35 p.m. Scott A. Smith remains in Cuyahoga County jail Wednesday afternoon, awaiting formal charges after his Saturday arrest for bringing a gun, ammunition and four knives into a late-night showing of The Dark Knight Rises at Regal Cinema. Smith's attorney, Matthew Bruce, anticipated a bond hearing Wednesday, but it did not happen. Nicole DiSanto of the Cuyahoga County Prosecutor's Office said Wednesday that Scott would remain in jail until formal charges are made. According to the Cuyahoga County Court of Common Pleas website, a formal hearing has been set for 1:45 p.m. Friday. No charges are listed on the docket. Scott A. Smith, arrested over the weekend for bringing a loaded gun, ammunition and four knives into Regal Cinema for a late-night showing of The Dark Knight Rises, was carrying the weapons for self-defense, his lawyer said Wednesday. After the Aurora, Colo., shootings and other incidents, Smith "felt fear" going to the movie by himself, attorney Matthew Bruce said.  "He brought (the weapons) in with him purely for self-defense," Bruce said. "He had no intent to harm, scare or threaten anyone." When Westlake police officer Jeremiah Bullins spotted Scott A. Smith in an empty movie theater at Regal Cinema, Smith was in the very back row, in the middle seat. A waist pack sat at his feet. Bullins, who was in uniform but working off-duty as security for Regal Cinema, had been suspicious of Smith after being alerted about him and his waist pack by a Regal Cinema employee. He approached Smith, and asked to search the waist pack. Smith agreed. With that, a potential tragedy was averted as Smith was arrested on weapons charges. "It could have been a disaster," Westlake Police Lieutenant Ray Arcuri said Tuesday. "Where (Smith) was, once he'd gotten started (shooting), there would have been multiple victims." Still say we need sensible gun laws. I differ with Bloomberg on some things but when he says we need better gun control laws, he is absolutely right. I agree you should be able to own a gun to protect yourself, hunt, target shoot, etc. But turning your house into an arsenal with numerous guns, assault rifles, and thousands of rounds of ammo should be illegal. Regal Cinema Employee, Westlake Police Officer Hailed for Preventing Tragedy

After a Regal Cinema employee spotted it, officer Jeremiah Bullins gave a second search of Scott Smith's bag in movie theater where "The Dark Knight Rises" was to be shown, finding a small cache of weapons.

The good eyes and good instincts of a Regal Cinema employee and an off-duty Westlake Police Department officer may have been the difference between a quiet Saturday night at the movies, and a horrific tragedy like the Aurora, Colo., shootings. According to Westlake police, an unidentified Regal Cinema employee spotted Scott A. Smith, 37, as he came into the cinema for a 10 p.m. showing of The Dark Knight Rises. He was wearing a Maxpedition waist pack, which may have looked like a fanny pack to most people. After security was alerted, a Regal Cinema manager approached Smith and asked to inspect his bag. A small arsenal of weapons were removed Monday night from the North Ridgeville home of Scott A. Smith, who was arrested after showing up armed with a gun, ammunition and four knives at a showing of The Dark Knight Rises Saturday night at Regal Cinema in Crocker Park. Westlake Police Department lieutenant Ray Arcuri said Tuesday afternoon that his department was still going through everything seized from Smith's home.
