Anthony J. Rose Jr., who was charged last week with vehicular manslaughter in the death of a construction worker in Avon, has pleaded not guilty.

Rose’s attorney filed not guilty pleas for the manslaughter charge as well as a minor misdemeanor charge to failure to maintain a clear distance.

In a newly released report from the Avon Police Department, police said Rose was traveling westbound on I-90 in the right lane shortly after 9 a.m. Sept. 12 when his 2006 Jeep Liberty struck the back of a 2008 Honda Odyssey driven by Nathan Reese of Avon. The cars were approaching the Nagel Road overpass that is under construction as part of the Nagel Road interchange project.

Police contend that Rose, 50, then moved into the left lane, back to the right lane before driving into a closed construction lane, eventually striking construction worker Peter Magklis, 63, a construction worker from Campbell, OH.

Rose, initially listed as a Brecksville resident, is listed as living in Broadview Heights, according to court documents.

Rose was charged on Sept. 27 with vehicular manslaughter a second-degree misdemeanor.

He is scheduled to appear in in Avon Lake Municipal Court at 9:30 a.m. on Oct. 23. 

The accident closed down I-90 westbound at Crocker Road for five hours. The investigation is continuing.
